RICHMOND, Va., April 18, 2005 /PRNewswire-FirstCall via COMTEX/ -- Insmed Incorporated (Nasdaq: INSM) On April 15, 2005, the United States District Court for the Northern District of California granted Insmed's Motion to Dismiss the Amended Complaint filed by Tercica, Inc. and Genentech, Inc. alleging patent infringement against Insmed. The Court granted Tercica and Genentech leave to file another amended complaint within thirty days. Insmed will evaluate any new Amended Complaint when it is received and will determine at that time how to proceed. The suit was originally filed by Tercica and Genentech on December 23, 2004, and an Amended Complaint was filed on February 16, 2005. Insmed filed its Motion to Dismiss, or in the Alternative, for Summary Judgment on February 18, 2005.
